These Terms & Conditions ("Terms") are a contract between you and Hypebook ("Hypebook," "we," "us," "our") and govern your use of the Hypebook websites, mobile experiences, and related services that link to these Terms (together, the "Service"). Please read them carefully. By creating an account or using the Service, you agree to be bound by these Terms.
1. Definitions
For convenience, here's what a few words mean in these Terms:
- "Account" means the account you create to use the Service.
- "Content" means anything you submit, upload, or display through the Service — achievements, descriptions, media, resumes, personal notes, profile information, and any other materials.
- "Hypepage" means your public portfolio page on Hypebook.
- "Public Vault" means the optional surface where visitors to your Hypepage can browse the wider set of achievements you've marked as public.
- "Hype" means a verification, endorsement, or recommendation that a third party (a "Verifier") provides about one of your achievements.
- "School" means an educational institution that uses Hypebook as part of an educational program and that you have linked to your Account.
- "You" means the individual using the Service through an Account.
2. Who Can Use Hypebook
To use the Service you must be at least 13 years old, or the higher minimum age required in your country (for example, 16 in parts of the European Economic Area, or as otherwise set by national law). If you are under that age, you may only use the Service if your school enrolls you in an educational program that obtains the consents required under applicable law (for example, COPPA in the United States) on your behalf.
If you are using the Service on behalf of a company, school, organization, or other entity, you represent that you have authority to bind that entity to these Terms, and "you" in these Terms will refer to that entity.
You may not use the Service if you are barred from doing so under any applicable law, or if your Account has previously been terminated by us for cause.
3. Your Account
Account creation
You're responsible for the information you provide when creating your Account and for keeping it accurate. You may sign in using credentials from a third-party identity provider (for example, Google); when you do, that provider's terms also apply to your sign-in experience.
Account security
You're responsible for safeguarding your Account, including your password and any other authentication credentials. Don't share your credentials. If you suspect your Account has been compromised, tell us immediately at legal@hypebook.xyz.
Communications
By using the Service you agree to receive transactional communications from us (for example, verification emails, security alerts, important Service announcements). You can opt out of non-essential communications via your Account settings or by following the unsubscribe link in the message.
4. Your Content and Licenses
You own your Content
You retain all ownership rights in your Content. Hypebook does not claim ownership of your achievements, descriptions, media, or any other material you submit.
License you grant to Hypebook
To operate the Service for you, you grant Hypebook a worldwide, non-exclusive, royalty-free license to host, store, reproduce, reformat, transmit, display, perform, and otherwise use your Content — but only for the purposes of providing, securing, and improving the Service. This license is limited to what we actually need to run the product (for example, displaying your achievement on your Hypepage when you publish it, generating a resume PDF, sending an email preview).
Public Content
If you choose to publish Content on a public surface (your Hypepage, Public Vault, or a shared resume link), you also grant a worldwide, non-exclusive, royalty-free license to anyone with access to that surface to view that Content for personal, non-commercial use. You can stop sharing at any time by removing the Content or making it private; visitors who already viewed or downloaded copies may retain them, and intermediate caches and search engines may take time to clear.
Verifier Content
When a Verifier provides a Hype on one of your achievements, the Verifier grants Hypebook a license (on the same terms as above) to associate that Hype with your Account and to display it on your Hypepage when you choose to feature the achievement. You may remove a Hype from display at any time through your Account.
Responsibility for Content
You are solely responsible for your Content and for the consequences of submitting or publishing it. Don't post anything you don't have the right to post or that violates these Terms.
5. Accuracy and No Fraud
Hypebook is a portfolio service. The integrity of what's on your profile matters. By using the Service you specifically agree:
- Not to fabricate, materially exaggerate, or misrepresent achievements, credentials, education, employment, awards, or any other facts about yourself.
- Not to claim degrees, certifications, or recognitions you have not earned.
- Not to solicit, coordinate, or accept Hypes from people who are not in a position to verify the underlying achievement, or who agree to write fabricated recommendations.
- Not to impersonate a Verifier or submit a Hype on your own behalf using another person's identity.
- Not to engage in reciprocal Hype arrangements designed to inflate the credibility of either party's profile.
- To correct or remove any Content as soon as you become aware that it is inaccurate.
Violations of this section are grounds for immediate Account suspension or termination and, where permitted by law, we may notify schools, employers, or other parties who have relied on the affected Content.
6. Public Profiles and Visibility
You control which parts of your profile are visible to others:
- Items in your private vault are visible only to you (and, where applicable, to your linked school).
- Items you feature on your Hypepage are visible to anyone with your Hypepage link.
- Items you mark as "public" become visible on your Public Vault when you enable that surface.
- Resumes you share via a shareable link are visible to anyone with the link.
Once Content is publicly accessible, anyone with the link can view, screenshot, archive, or share it. We cannot guarantee that public Content will not be cached by intermediate networks, indexed by search engines, or otherwise persist after you make it private. Please publish thoughtfully.
7. Hypes (Verification)
If you request a Hype
By sending a Hype request, you authorize Hypebook to contact the Verifier on your behalf using the email address you provide and to record their response against the achievement. You confirm you have a real basis to request verification from that person.
If you respond to a Hype request as a Verifier
By responding, you confirm that the information you provide is accurate to the best of your knowledge and that you have a legitimate basis to verify or comment on the achievement. You grant Hypebook the license described in Section 4 to associate your response with the student's Account. You may decline or request changes instead of verifying.
Verifier identity display
For public-facing surfaces, Hypebook displays your name, title, and (if you provide one) profile image alongside your Hype, together with the domain of your email address as a credibility signal. We do not display your full email address publicly.
8. AI-Assisted Features
Some features of the Service use third-party AI providers to suggest, summarize, or reformat Content (for example, the AI resume assistant). When you use these features:
- AI output is a draft, not a substitute for your judgment. You are responsible for reviewing, editing, and approving anything before you publish it.
- AI suggestions can be wrong, biased, or out of date. Don't rely on them for any decision with legal, financial, academic, or career consequences without independent verification.
- You retain the responsibilities in Section 5 (Accuracy and No Fraud) for any Content you publish, whether you wrote it or AI helped draft it.
- Our use of AI providers is described in our Privacy Policy.
9. School Integration
If you link your Account to a School, or if a School invites you to Hypebook as part of an educational program, additional rules apply:
- Your School may have its own terms, acceptable-use policy, or code of conduct that governs your behavior while participating in its program. Those rules apply in addition to these Terms.
- Your School may view aspects of your activity inside its program, as described in our Privacy Policy.
- If your School removes you from its program, your participation in that program's surfaces may end. Your personal Account and Content created outside the School's program remain yours.
- If your School disputes the accuracy of credentials you have asserted (for example, a claim of graduation), we may suspend the affected Content while it's reviewed.
10. Acceptable Use
You may not use the Service to:
- Violate any law or anyone else's rights (including intellectual property, privacy, or publicity rights).
- Post or transmit material that is unlawful, threatening, abusive, defamatory, obscene, hateful, or invasive of another's privacy.
- Harass, bully, intimidate, or impersonate any person.
- Upload viruses, malware, or any code designed to interfere with the Service.
- Attempt to gain unauthorized access to the Service, other Accounts, or any related systems.
- Scrape, crawl, or use automated means to access the Service except through interfaces we expressly authorize.
- Resell, sublicense, or otherwise commercially exploit the Service or any data accessed through it, except where we have given you express written permission.
- Use the Service to send unsolicited bulk messages or spam, including unsolicited Hype requests.
- Circumvent any technical limit, rate limit, security feature, or access control of the Service.
11. Suspension and Termination
Termination by you
You can stop using the Service at any time. You can request deletion of your Account from your Account settings or by contacting us at privacy@hypebook.xyz. See our Privacy Policy for what happens to your data after deletion.
Suspension or termination by Hypebook
We may suspend or terminate your Account, or restrict access to particular features, if:
- You violate these Terms (including Section 5 and Section 10);
- We're required to do so by law, regulation, or legal process;
- Your use of the Service creates a security, fraud, or legal risk for Hypebook or its users; or
- Your School ends your participation in its program (with respect to that program's surfaces only).
Where reasonable, we'll give you notice and an opportunity to fix the problem. Where conduct is severe (for example, fabricated credentials, fraud, abuse, or a security threat), we may suspend or terminate without prior notice.
Effect of termination
On termination your right to use the Service ends. Provisions that by their nature should survive termination (including Sections 4, 5, 13–18, and 20) will survive.
12. Changes to the Service
We're actively building Hypebook. We may add, change, or remove features at any time, and we may release new features in beta or as experiments. We'll try to give reasonable notice for changes that materially reduce functionality you actively rely on, but the Service is not guaranteed to be uninterrupted or unchanged.
13. Third-Party Services and Links
The Service integrates with third-party services (for example, identity providers, storage, email and AI providers — see our Privacy Policy for the current list). When you sign in with a third-party provider or import data from a connected service, that provider's terms also apply. Hypebook is not responsible for third-party services, websites, or content linked from the Service.
14. Paid Features
Some features may be offered for a fee. If you purchase a paid feature, the pricing, billing terms, refund policy, and any additional terms presented at the point of purchase form part of these Terms with respect to that purchase. Payment processing is handled by our payment processor and is also subject to that processor's terms.
15. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by applicable law, Hypebook disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranty of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components, or that any defect will be corrected. Information and AI output you receive through the Service is for general informational purposes only and should not be relied on as professional, legal, financial, medical, academic, or career advice.
Some jurisdictions don't allow the exclusion of certain warranties; in those jurisdictions, the exclusions above apply only to the extent permitted by law.
16. Limitation of Liability
To the maximum extent permitted by applicable law:
- Hypebook will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, opportunity, or other intangible losses, arising out of or in connection with these Terms or the Service, whether in contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
- Hypebook's aggregate liability for all claims arising out of or in connection with these Terms or the Service will not exceed the greater of (a) the amount you have paid to Hypebook in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law (for example, liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot be lawfully limited).
17. Indemnification
You will defend, indemnify, and hold harmless Hypebook and its officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your Content; (b) your use of the Service in violation of these Terms; (c) your violation of any law or any right of another person; or (d) any Hype you submit as a Verifier. We may, at our option, assume the exclusive defense and control of any matter subject to indemnification by you; if we do, you will cooperate with our defense.
18. Governing Law and Dispute Resolution
These Terms are governed by the laws of [jurisdiction to be confirmed], without regard to its conflict-of-laws principles. The exclusive venue for any dispute that cannot be resolved informally will be the competent courts of [forum to be confirmed], and you and Hypebook consent to the personal jurisdiction of those courts.
Before filing a claim, you agree to first contact us at legal@hypebook.xyz and try in good faith to resolve the dispute informally for at least thirty (30) days.
If you are a consumer in a jurisdiction whose mandatory law gives you the right to bring proceedings in the courts of your country of residence, nothing in this section limits that right.
19. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the date at the top and, where appropriate, notify you by email or through the Service. The updated Terms take effect when posted unless we say otherwise. Your continued use of the Service after the update means you accept the new Terms; if you don't agree, you should stop using the Service and may delete your Account.
20. General Provisions
Entire agreement
These Terms (together with the Privacy Policy and any terms presented at the point of purchase for paid features) are the entire agreement between you and Hypebook regarding the Service, and supersede any prior agreement on the same subject.
Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in effect, and the unenforceable provision will be replaced or modified to the minimum extent necessary to make it enforceable while preserving its intent.
No waiver
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
Assignment
You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets, or by operation of law.
No agency
These Terms do not create any agency, partnership, joint venture, employment, or franchise relationship between you and Hypebook.
Notices
We may give notices to you by email to the address on your Account, by posting on the Service, or by any other reasonable means. You should give notices to us at the contact addresses below.
